The DMCA

The Digital Millennium Copyright Act (“DMCA”) creates a standardized process for copyright holders to request that Untapped Authority remove infringing content. More information is available at the U.S. Copyright Office’s official website.

As with all legal matters, it is strongly recommended you consult a licensed attorney regarding any DMCA action. Our guides and instructions do not constitute legal advice.

Accurate Information:

  • The DMCA requires that you swear to the facts in your notice of infringement under penalty of perjury.

  • It is a federal crime to intentionally lie in a sworn declaration (U.S. Code, Title 18, Section 1621). False statements could result in civil liability.

Investigate Before Filing:

  • Filing a DMCA notice is a serious legal action with real consequences.

  • Please investigate thoroughly and consider contacting the alleged infringer before submitting a notice.

No Automated Bots:

  • Ensure any third party assisting you does not submit takedown notices automatically or in bulk. Automated submissions are often invalid and may unnecessarily take down content.

Counter Notices:

  • Any user affected by your takedown notice may submit a counter notice. If a valid counter notice is received, we may re-enable content within 14 days unless legal action is initiated to restrain the alleged infringer.

Our Role:

  • Untapped Authority exercises minimal discretion other than verifying the notice meets DMCA requirements.

  • Determination of the legal merits is up to the parties and their legal counsel.

DMCA Takedown Notice

If you believe your copyrighted content is being used without authorization on our website or services, please email contact@untappedauthority.ca. You may attach documents, but also include a plain-text version in your email body. Your notice should include:

  1. Your physical or electronic signature (typing your full name is sufficient).

  2. Identification of the copyrighted work claimed to be infringed.

  3. Identification of the allegedly infringing material with enough detail for us to locate it.

  4. Your contact information (address, phone number, and email).

  5. A statement under good faith that the use is not authorized by the copyright owner or law.

  6. A statement that the information in your notice is accurate and that you are authorized to act on behalf of the copyright owner.
